PolyFir Group – Terms of Use (Users)

1. Platform Overview and Acceptance

PolyFir Group is a digital platform that allows Users to browse, purchase, download, and use digital content, including mods and other digital resources for supported video games.

These Terms apply to all Users and all interactions with the Platform and its services.

We may update these Terms at any time. Changes take effect once published on the Platform. Continued use of the Platform constitutes acceptance of the updated Terms.

2. Definitions

Platform: The PolyFir Group website, services, and associated digital infrastructure.

User: Any person accessing or using the Platform.

Account: A personal user profile created to access certain features.

Content: Digital products, files, or resources made available for download or access on the Platform.

Services: All features and functionalities offered by PolyFir Group.

3. Access and User Accounts

3.1 Platform Access

The Platform is accessible using a compatible device and internet connection. Certain features require account creation.

We may suspend or restrict access for maintenance, security, or operational reasons.

3.2 Account Creation

Users must provide accurate and up-to-date information and agree not to:

• Impersonate another person
• Use false or misleading information
• Create multiple accounts for abusive purposes

We reserve the right to suspend or delete accounts that violate these Terms.

3.3 Account Security

Users are responsible for safeguarding their login credentials.

PolyFir Group is not liable for losses resulting from unauthorized account access due to user negligence.

3.4 Minimum Age

Users must be 13 years or older.

Users under 18 confirm they have permission from a parent or legal guardian.

4. Digital Content and Intellectual Property

4.1 Ownership

All Platform-owned elements (website design, branding, text, code, interfaces) are the exclusive property of PolyFir Studios and Asphotech and are protected by intellectual property laws.

Unauthorized reproduction or distribution is prohibited.

4.2 License to Users

Upon purchase, Users receive a non-exclusive, non-transferable, revocable license to download and use the purchased digital content for personal use only, subject to:

• The terms of the original content license
• Applicable game publisher rules
• These Terms

No ownership rights are transferred to the User.

4.3 Restrictions

Users may not:

• Redistribute, resell, or share purchased content
• Modify content for commercial purposes
• Circumvent DRM or access restrictions
• Claim ownership of the content

5. Payments, Digital Goods, and Refunds

5.1 Payments

All payments on the Platform are processed through third-party payment providers, such as Stripe or equivalent services.

PolyFir Group does not store or process payment card data directly.

By completing a purchase, the User agrees to the payment provider's terms and policies.

5.2 Digital Delivery

Purchased content is delivered digitally and is generally available immediately after payment confirmation.

Users are responsible for ensuring their system meets technical requirements.

5.3 Refund Policy (Stripe-Compliant)

Due to the nature of digital, downloadable content, all sales are final, except where:

• The content cannot be accessed or downloaded due to a technical failure attributable to the Platform
• Required by applicable consumer protection laws

Refund requests must be submitted within a reasonable time via official support channels and are reviewed on a case-by-case basis.

6. User Conduct

Users agree not to:

• Use the Platform for illegal purposes
• Engage in fraud, chargeback abuse, or payment disputes in bad faith
• Attempt to bypass payment systems or security measures
• Disrupt Platform services or infrastructure

Abusive behavior, including fraudulent refund claims or chargeback manipulation, may result in account termination.

7. Disclaimers and Limitation of Liability

7.1 No Warranty

The Platform and all content are provided "as is" and "as available".

We make no guarantees regarding uninterrupted service, compatibility, or error-free operation.

7.2 Limitation of Liability

To the maximum extent permitted by law, PolyFir Group shall not be liable for:

• Indirect or consequential damages
• Data loss
• Incompatibility with third-party software or hardware
• Losses caused by misuse of digital content

Our total liability shall not exceed the amount paid by the User for the affected purchase.

8. Privacy and Data Protection

Personal data is collected only as necessary to operate the Platform.

Payment data is handled exclusively by third-party processors. We do not sell or share personal data for commercial purposes.

Users may request account and data deletion, subject to legal and accounting obligations.

9. Account Suspension and Termination

Users may request account deletion at any time.

We may suspend or terminate accounts if:

• These Terms are violated
• Fraud or abuse is suspected
• Required by law or payment processors

Termination results in immediate loss of Platform access. Previously purchased content may remain accessible where technically feasible.

10. Governing Law

These Terms are governed by the laws of Québec, Canada.

Any dispute shall fall under the exclusive jurisdiction of the courts of Montréal, Québec, unless otherwise required by law.
